The determination of who is at fault for an automobile accident is base on the Fault Determination Rules. The Fault Determination Rules are regulations that lay out over 40 possible ways an accident can occur. These Rules are strictly applied.
If you are 100 percent not at fault for the accident, your vehicle should be repaired or replaced by your insurance company.
You do not pay a deductible for the repair or replacement of your vehicle.
Your premium should not increase as a direct result of the accident or your claim.
If you are partially (1% - 99%) at fault for the accident and you have collision coverage on your auto insurance policy, the percentage of the deductible you will pay is based on the percentage you were at fault for the accident. Example, if you had a deductible of $500 and you were 50% at fault for the accident, you would pay $250 of the deductible.
If you are partially at fault for the accident and you do not have collision coverage on your policy, your insurance company will not be responsible for the repair or replacement of your vehicle.
Your premium will increase, unless you have accident forgiveness for your first at-fault accident. You will also have an at fault on your insurance record.
If you are 100 percent at fault for the motor vehicle accident and you have collision coverage on your auto insurance policy, you will pay the entire deductible per your insurance contract.
If you do not have collision coverage on your policy, your insurer will not be responsible for the repair or replacement of your vehicle.
Your premium will increase, unless you have accident forgiveness for the first at fault accident. You will also have an at fault on your insurance record.
