Damages Claimable Under A BI Claim

The injury-related losses and expenses you suffer as a result of the automobile accident are referred to in a BI claim as damages.  


The damages you can claim here are pain and suffering, loss of enjoyment with a family member, and all other eligible, injury-related losses and expenses that were not paid or are not payable under your AB claim, such as the following:

  • Past income loss 
  • Future Income loss
  • Caregiving expenses
  • Housekeeping and home maintenance expenses
  • Medical and rehabilitation expense


The "pain and suffering" and "loss of enjoyment with a family member" aspect of the damages are subject to a deductible. The deductible is applied only if the amount payable is not over a specified amount. Both the deductible and the specified amount increases every year.  


The maximum payable by the Defendant's insurance company for your damages is generally $1,000,000.00. Any amount awarded above the before mentioned maximum amount is the responsibility of the Defendant to pay you.
