Who Can Make An AB Claim

Virtually Anyone Involved in an Automobile Accident in Ontario, Canada

Virtually any person injured as a result of an automobile accident that occurred in Ontario, Canada can make an AB claim. This includes persons not listed on yours or any other auto insurance policy. Individuals such as:

  • a spouse of a named insured
  • dependents of a named insured
  • pedestrians
  • passengers
  • residents of Ontario during the 60 days prior to the accident

Automobile Accidents that Occurred Outside of Ontario, Canada

If the auto accident and related injury occurred outside of Ontario, Canada; only the following relative of an auto insurance policy holder can make an AB claim under the auto insurance policy of the holder:

  • the named insured, 
  • specified driver and 
  • their spouse or dependants. 

Immediate Family Member Not Involved in the Accident

An AB claim can be made by the 

  • named insured, 
  • specified driver and 
  • their spouse or dependants

who were not involved in an automobile accident but suffers a psychological or mental injury as a result of an auto accident that occurred in or outside of Ontario, Canada that resulted in a physical injury to his or her 

  • spouse, 
  • child, 
  • grandchild, 
  • parent, 
  • grandparent, 
  • brother, 
  • sister, 
  • dependant or 
  • spouse’s dependant.
